Man wearing protective suitThe control of asbestos at work regulations 2002 (CAWR) introduced explicit duty to manage asbestos in non-domestic premises. This legislation tackles the biggest occupational health killer in the UK related disease.

Of the 3,000 people dying currently dying each year from such diseases 25% having once worked in the building and maintenance trades and often would have worked unknowingly on and near to asbestos containing materials (ACMs)

The duty holder is responsible for the safe management of asbestos containing material (ACM) within such premises. In order to enable him to manage the risk from asbestos, the duty holder shall ensure that a suitable and sufficient assessment is carried out as to whether asbestos is or is liable to be present in the premises.

The duty holder must ensure that the risk from the asbestos is assessed, that a written plan identifying where that asbestos is located is prepared and that measures to manage the risk from the asbestos are set out in that plan are implemented. Associated parties have a legal duty to cooperate with the duty holder,

Complying with these regulations means the completion of an asbestos survey. By carrying out an asbestos survey, a risk assessment/ management plan can be produced which should prevent or reduce exposure.
